On December 19, 2018, the US District Court of the Southern District of Indiana ruled in favor of Aaron Isby-Israel’s claims of violations of his due process rights committed by Wabash Valley Correctional Facility Staff and the Indiana Department of Corrections by holding him in solitary confinement (aka administrative segregation) indefinitely and without appropriate review as required by the US Constitution. The judge issued an injunction requiring that Mr. Isby-Israel be released from solitary confinement and receive compensation of over $400,000. The injunction required that the DOC submit a plan for releasing Mr. Isby-Israel from solitary confinement by January 4, 2019. Please see our follow-up post for the plan the DOC submitted and Mr. Isby-Israel’s response.
Below is the full order issued by the US District Court on December 19, 2019.
